A Crescent City man who got a 14-year-old girl drunk and attempted to sexually assaulted her was sentenced in the Del Norte Superior Court Thursday.
Tracy Haggard will serve three years and four months at San Quentin State Prison for producing child pornography and attempted molestation of a minor between 14 and 15-years-old.
Haggard was the caretaker of his 14-year-old victim when he gave her alcohol. She happened to be a diabetic, and this raised her blood sugar levels to four-times normal, causing her to pass out. Haggard then began undressing her and taking photographs.
"This victim was particularly vulnerable," said Del Norte District Attorney Mike Riese during the sentencing. "She was more vulnerable because she was a diabetic, and he (Haggard) knew that."
As Haggard sobbed uncontrollable, his attorney, Darren McElfresh, read a handwritten apology prepared by his defendant.
"Nobody regrets it more than I," McElfresh read. "Now I live my life with a heavy heart of regret and shame."
But this apology did little to deter Judge Robert Weir from handing down the maximum sentence. Due to Haggard's spotty criminal past and mostly because of the vulnerability of his victim, Weir gave Haggard the aggravated sentence.
