A former Girl Scout volunteer is headed to prison for a lewd and lascivious act with a minor.

Christopher Kaboos, 41, Crescent City, was sentenced to a mid-range term of two years in prison by Del Norte Superior Court Judge William Follett on Thursday.

The conviction stems from a January incident at his house when he molested a 14-year-old girl who was sleeping over at his house, authorities said.

During a presentence investigation with a probation officer, Kaboos denied molesting the girl though admitted to kissing her, court documents state.

"Victim's version is more than just touching over her clothes," said Follett, during the sentencing. "It was clear he was trying to have some sort of relationship with her."

Kaboos addressed the court.

"I am deeply sorry," said Kaboos. "All I can ask for is forgiveness, I don't expect it."

Kaboos had 413 days of custody credit that will be applied to his sentence. During the presentence investigation report, he relayed that he is afraid to go to prison because of his small stature.

Kaboos had pleaded guilty in an open plea that opens up the sentencing to be relegated at the judge's discretion based on the factors and circumstances of the case.

Kaboos faced a maximum of three years in prison.

Follett considered the mitigating and aggravating factors in the case to offset each other.

The probation department was seeking a maximum penalty, defense attorney Leroy Davies soughtthe lightest sentence and acting-District Attorney Katherine Micks sought the middle term.

Kaboos will be eligible for half-time credits in prison, according to the probation department.
